Status: 1 October 2026 · Draft. This translation is for information only; the German AGB are legally binding.
1 Scope
(1) These Terms apply to all contracts between Tutti Studio I GmbH ("TUTTI", "we") and its customers ("member", "customer", "you") for class participation, credits, class packs, memberships, gift vouchers, use of the studio and café, and use of our website and online booking system.
(2) Your own terms do not apply unless we expressly accept them. Individual agreements take priority.
(3) A consumer is any natural person entering into a transaction mainly outside their trade or profession (Section 13 BGB). Separate agreements may apply to corporate customers (e.g. corporate classes, studio buyouts).
(4) For bookings through partners (e.g. Urban Sports Club, ClassPass, EGYM Wellpass), the partner's terms govern your contract with the partner. Sections 10–14 and the house rules also apply to your studio visit.
2 Provider and contact
Tutti Studio I GmbH, Perlacher Straße 66, 82031 Grünwald · Managing directors: Nicholas Peisch, Constantin Greinacher · Munich Local Court, HRB 305953 · VAT ID DE457965664 · Email: info@tutti-studios.com · Phone: +49 172 1434877 · Studio: Fürstenfelder Straße 7, 80331 Munich.
The website www.tutti-studios.com is operated by Vitality Fitness Group GmbH (see Imprint). Your contractual partner for all services under these Terms is solely Tutti Studio I GmbH.
3 Services
(1) TUTTI offers coached group classes in the formats Pulse (e.g. HYROX, Metcon, Strength), Flow (e.g. Sculpt, Strength, Restore) and Form (reformer Pilates), and may offer further formats, events, personal training and recovery services. Content, duration and capacity are shown in each class description in the booking system.
(2) The schedule is updated regularly. We may change individual classes, times or coaches where reasonable for you and the character of the offer is maintained. There is no entitlement to a particular coach, time slot or spot.
(3) The studio is closed or has reduced hours on Bavarian public holidays and on up to 10 further days per calendar year (e.g. maintenance, renovation). We announce planned closures at least 14 days in advance. For closures beyond this, we extend affected credits or reduce membership fees pro rata.
(4) Showers, changing rooms and lockers are available during your visit. Lockers are for use during your visit only; we may remove and store items left overnight.
4 Conclusion of contract
(1) Offers shown on our website, app and in the studio are not binding offers but an invitation to order.
(2) Online, you make a binding offer by selecting a product, checking your details and clicking "order with obligation to pay" (or equivalent). The contract is concluded when we confirm by email or activate the credits in your account. In the studio, the contract is concluded on payment or signature.
(3) You can review and correct your entries before ordering. We store the contract text; you can view and save these Terms on our website at any time. The contract language is German; an English version is provided for information.
(4) Our booking and payment system is operated by a service provider (currently bsport). TUTTI remains your sole contractual partner.
5 Account and eligibility
(1) Booking requires a personal account. One account per person. Your details must be accurate and current. Keep your login details confidential and tell us immediately about any misuse.
(2) Minimum age is 16. Minors need their legal guardian's consent in text form; the guardian also agrees to these Terms. We may ask for proof of age.
(3) Credits, memberships and bookings are personal and non-transferable, except gift vouchers (Section 15) and bookings expressly offered for guests.
6 Credits, single classes and class packs
(1) Classes are booked with credits. One class costs one credit unless stated otherwise in the booking system (e.g. specials, events, personal training).
(2) Single classes and class packs are prepaid, with no term and no automatic renewal. Credits are valid from purchase as follows: Single Class (drop-in) and 2-Class Pack 1 month, 5-Class Pack 3 months, 10-Class Pack 6 months, 20-Class Pack 9 months. Validity is shown at checkout.
(3) Once expired, unused credits can no longer be used for bookings. Further statutory claims remain unaffected.
(4) Intro offers can be purchased once per person and are for first-time customers only. In case of misuse, we may charge the difference to the regular price.
7 Memberships
(1) Memberships include a monthly credit allowance. We offer:
- 8-Class Monthly Membership: 8 credits per billing month
- 12-Class Monthly Membership: 12 credits per billing month
- 30-Class Monthly Membership: 30 credits per billing month
Each membership is available as a monthly cancellable version with no minimum term (para. 3) or with a 12-month minimum term at a lower monthly price (para. 4).
(2) Credits are added at the start of each billing month and are valid for that billing month only. Unused credits expire at its end and do not roll over.
(3) Memberships without a minimum term run indefinitely and can be cancelled at any time with 14 days' notice to the end of the billing month.
(4) Memberships with a minimum term can first be cancelled with one month's notice to the end of the 12-month minimum term. If not cancelled, the membership continues indefinitely at the same monthly price and can then be cancelled at any time with one month's notice.
(5) Upgrading (e.g. from 8 to 12 classes) is possible from the next billing month; the minimum term is unchanged. Downgrading during a minimum term requires our consent.
8 Cancellation
(1) Cancellation must be made in text form (e.g. email to info@tutti-studios.com). Memberships concluded online can also be cancelled via the "Cancel contracts here" button on our website. We confirm receipt promptly in text form.
(2) Both parties' right to terminate for good cause (Section 314 BGB) is unaffected. Good cause on your side exists in particular if illness, injury or pregnancy permanently prevents you from training, or for the rest of the term. A doctor's certificate is required; no diagnosis needs to be stated.
(3) We may terminate for good cause in particular if you (a) are in arrears with an amount equal to two monthly fees, or (b) have repeatedly or seriously breached the house rules despite a warning (e.g. harassment, violence, theft). No warning is needed where it would be unreasonable.
9 Prices and payment
(1) Prices shown at the time of order apply, in euros incl. VAT.
(2) Class packs, single classes and vouchers are payable on order. Membership fees are payable monthly in advance at the start of the billing month; for minimum-term memberships, 12 months may be prepaid at a discount. Payment methods: SEPA direct debit, credit card and others shown at checkout. Cash is not accepted.
(3) TUTTI reserves the right to adjust prices at any time. We announce price changes on the website and by email; for running memberships they apply from the billing month following the announcement. Continuing the membership counts as acceptance of the new price. If you don't agree, you may cancel the membership effective when the price change takes effect.
(4) If a direct debit is returned for insufficient funds or an unjustified objection, you reimburse the bank charges actually incurred, max. EUR 10 per return. You may prove that no or lower damage occurred. While payments are overdue, we may block bookings.
(5) Special rates (e.g. students) require valid proof on request. If eligibility ends, the regular price applies from the following billing month; please tell us.
10 Booking, cancellation and waitlist
(1) Classes can be booked via website or app usually at least 7 days ahead (booking window as shown in the booking system), subject to availability, first come, first served.
(2) You can cancel free of charge up to 12 hours before class; the credit is returned to your account. The same applies to switching classes.
(3) For later cancellations or no-shows, the credit is forfeited.
(4) Please arrive at least 5 minutes before class, 15 minutes on your first visit. If you haven't checked in 5 minutes before start, we may give your spot to the waitlist; the credit is then forfeited as for a no-show. Late entry is not possible for safety reasons.
(5) If a class is full, you can join the waitlist. If a spot opens, you are moved in automatically, notified and the credit is used. Being moved in within the cancellation window counts as a binding booking unless you cancel within 1 hour of notification and at least 1 hour before class.
(6) If we cancel or materially change a class (e.g. different format), we inform you as early as possible by email or push notification and return the credit; for a material change you may cancel free of charge. Further claims only under Section 13.
(7) In case of illness or similar unforeseen events, you may request the return of a forfeited credit with proof; we decide fairly. Different deadlines may apply to events and specials and are shown at booking.
11 Health and personal responsibility
(1) Our classes are physically demanding. You confirm you know of no health reasons against participating. With pre-existing conditions, after injuries or surgery, and during and after pregnancy, we recommend seeing a doctor first.
(2) Tell your coach before class about injuries, symptoms, pregnancy or anything else relevant to your safety. If you feel unwell during class, stop and tell the coach.
(3) Some classes use light and sound effects (e.g. strobe). Please tell us beforehand if you have epilepsy or photosensitivity.
(4) Coaches may refuse or limit participation where they see a risk (e.g. alcohol, acute injury). The credit is then returned unless the exclusion is due to a breach of the house rules.
12 House rules and conduct
(1) The house rules displayed in the studio and on our website apply (summary in Annex 3). Instructions from coaches and staff must be followed.
(2) We expect everyone to treat each other with respect. Discrimination, harassment, violence and threats are not tolerated and may lead to a ban and termination for good cause.
(3) Audio, photo and video recordings of other people or of classes require the consent of those concerned and of TUTTI. Recording yourself before or after class is fine if no one else is identifiable.
13 Liability
(1) Training, class participation and use of the studio are at your own risk. TUTTI accepts no liability for damage to health, in particular where health limitations were not disclosed to the team in advance.
(2) By booking, you acknowledge the risks of fitness training and release TUTTI, its staff, coaches and partners from any liability for injury or other damage arising in connection with your participation.
(3) TUTTI is not liable for loss of or damage to personal belongings, nor for damage caused by force majeure. Please don't bring valuables and use the lockers.
(4) These exclusions also apply to our staff, coaches and agents. You are liable under statutory law for damage you cause intentionally or negligently to equipment or facilities.
14 Café and products
(1) Our café offers food, drinks, smoothies and shakes, ordered on site or via the booking system, at the prices shown. Allergen information is available at the counter.
(2) Pre-ordered items must be collected on the day of order within 30 minutes after class; uncollected fresh items are not refunded. Statutory warranty rights apply to goods (e.g. merchandise).
(3) Outside food and alcohol are not allowed in training areas; non-alcoholic drinks in closed bottles are fine.
15 Gift vouchers
(1) Vouchers can be redeemed for class packs, single classes and memberships (not for café products). They are transferable; no cash payout.
(2) Vouchers are valid for three years from the end of the year of purchase. Credits obtained by redeeming a voucher follow the validity of the respective product (Section 6).
16 Data protection and video surveillance
(1) We process personal data for contract performance, bookings, billing and customer service. Details, including your rights, are in our privacy policy (www.tutti-studios.com/datenschutz).
(2) We process health information only if you share it voluntarily with your explicit consent, and only for your safety in training.
(3) To protect guests, staff and premises, the studio's common areas (café, staircase and hallways) are under video surveillance. Changing rooms and bathrooms are excluded. Recordings are deleted after 72 hours at the latest unless needed to investigate an incident.
17 Photos and videos by TUTTI
(1) Some classes or events may be photographed or filmed for our communications. We mark these in the schedule (e.g. "FILMED").
(2) We only publish recordings in which you are identifiable with your separate consent. You can withdraw it at any time for the future; we remove published content where possible and reasonable. Without consent, you train outside the filmed area or we make you unrecognisable.
18 Right of withdrawal
(1) Consumers have a statutory right of withdrawal for contracts concluded online or off-premises, as set out in the withdrawal notice (Annex 1). For contracts concluded online, you can also use the "Withdraw from contract" button on our website.
(2) There is no right of withdrawal for leisure services booked for a specific date, in particular single bookings of a specific class or event (Section 312g (2) no. 9 BGB).
(3) If you ask us to start the service before the withdrawal period ends (e.g. by using credits), on withdrawal you pay a reasonable amount for services already provided, based on credits used or time elapsed relative to the total contract.
19 Changes to these Terms
(1) New contracts are governed by the version in force at conclusion.
(2) TUTTI reserves the right to change these Terms at any time. We notify changes by email and publish them on the website. Continuing an existing membership or continuing to use our services after the changes take effect counts as acceptance. If you don't agree, you may cancel the membership effective when the changes take effect.
20 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law does not remove protection under mandatory law of their country of habitual residence.
(2) If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the place of jurisdiction is Munich.
(3) Notice under Section 36 VSBG: we are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
(4) If any provision is or becomes invalid, the rest remain valid; statutory law replaces the invalid provision.
(5) In case of doubt, the German version of these Terms prevails.
